Welcome to NOVARA DIGITAL LAB (NDL)! These Terms of Service govern your use of our website at novaradigitallab.org and the programs, services, and resources we offer. NOVARA DIGITAL LAB is a nonprofit organization based in Sonoma County, California, dedicated to digital equity, hands-on technology training, and accessible tools for underserved communities, small businesses, and local nonprofits. By accessing or using our platform or participating in our programs, you agree to comply with these terms and conditions.
User Responsibilities
Account Creation: If you create an account to access NDL resources, register for programs, or use our tool checkout system, you are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Please notify us immediately if you suspect unauthorized access.
Prohibited Activities: You agree not to engage in any illegal, unauthorized, or abusive activities on our platform or within our programs. This includes but is not limited to spamming, unauthorized access or hacking, harassment of staff or community members, and violations of intellectual property rights.
Content Guidelines: If you upload, post, or share content through our platform or in connection with NDL programs, you are responsible for ensuring that content does not infringe upon the rights of others or contain offensive, defamatory, or harmful material. NDL reserves the right to remove content that violates these guidelines.
Program Participation
NDL offers a range of programs including digital literacy workshops, one-on-one technology support, equipment and tool lending, and training cohorts for entrepreneurs and community members. Participation in NDL programs is subject to availability, eligibility requirements specific to each program, and adherence to community standards. NDL reserves the right to remove participants from programs for conduct that is harmful, disruptive, or inconsistent with our community values.
Tool and Equipment Lending
Participants who borrow equipment through NDL's tool checkout system agree to use borrowed items responsibly, return them in the same condition in which they were received, and promptly report any damage or malfunction. Failure to return equipment or willful damage may result in the participant being held responsible for repair or replacement costs and suspension from future lending privileges.
Intellectual Property
Our website, training materials, curriculum, graphics, and other original content are protected by intellectual property laws. You may not reproduce, distribute, or adapt NDL content for commercial use without express written permission. Educational and personal use of materials provided during programs is encouraged and permitted.
Privacy
Your privacy matters to us. Please review our Privacy Policy at novaradigitallab.org/privacy to understand how we collect, use, and protect your personal information. NDL does not sell or share participant data with third parties for commercial purposes.
Donations and Program Fees
Some NDL programs may involve nominal participation fees to cover materials or operational costs. These fees, where applicable, will be clearly communicated before enrollment. Donations made through our platform are processed securely through our donation processor and are used to fund NDL's programs and operations. NDL does not store payment or card information directly. All eligible donations may be tax-deductible to the extent permitted by law, pending confirmation of NDL's 501(c)(3) status.

NDL's platform and programs are provided "as is" without warranties of any kind, express or implied. While we strive to provide accurate, reliable, and beneficial services, we do not guarantee that our services will meet every individual need or be error-free.
Limitation of Liability

These Terms of Service are governed by the laws of the State of California. Any disputes arising from these terms shall be resolved through good-faith mediation, and if unresolved, through binding arbitration in Sonoma County, California.
